1. Agreement to Terms

By accessing or using ClicksApp ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

ClicksApp provides cloud-based communication services including but not limited to Cloud PBX, Contact Center, WhatsApp integration, Automation Workflows, and AI Voice Agent services. We reserve the right to modify, suspend, or discontinue any part of the Service at any time.

3. Account Registration

To use our Service, you must:

• Provide accurate, current, and complete information
• Maintain and update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Be at least 18 years of age or have parental consent

4. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose or in violation of any laws
• Transmit any harmful, offensive, or inappropriate content
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to any part of the Service
• Use automated systems to access the Service without permission
• Resell or redistribute the Service without authorization
• Use the Service to send spam, phishing, or fraudulent communications

5. Payment Terms

5.1 Subscription Fees

Subscription fees are billed in advance on a monthly or annual basis. Fees are non-refundable except as required by law or as explicitly stated in our refund policy.

5.2 Price Changes

We reserve the right to modify pricing with 30 days' notice. Continued use of the Service after price changes constitutes acceptance of the new pricing.

5.3 Payment Failure

If payment fails, we may suspend or terminate your account. You remain responsible for all charges incurred.

6. Service Level Agreement

We strive to maintain 99.99% uptime for our Service. However, we do not guarantee uninterrupted or error-free service. Scheduled maintenance will be communicated in advance when possible.

7. Intellectual Property

The Service, including all content, features, and functionality, is owned by ClicksApp and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or create derivative works without our written permission.

8. User Content

You retain ownership of content you submit through the Service. By submitting content, you grant us a license to use, store, and process that content to provide the Service. You are responsible for ensuring you have the right to submit any content.

9. Data Protection

Your use of the Service is also governed by our Privacy Policy. We implement appropriate security measures to protect your data.

10. Termination

10.1 By You

You may terminate your account at any time by contacting us or using account management tools.

10.2 By Us

We may suspend or terminate your account immediately if you violate these Terms or engage in fraudulent, illegal, or harmful activities.

10.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. We may delete your account and data in accordance with our data retention policies.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLICKSAPP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

12. Indemnification

You agree to indemnify and hold harmless ClicksApp from any claims, damages, losses, liabilities, and expenses arising from your use of the Service or violation of these Terms.

13. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through good faith negotiation. If negotiation fails, disputes shall be resolved in accordance with the laws of Saudi Arabia, with jurisdiction in the courts of Riyadh.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.
